We provide access to Our Platform by assigning an Account to Users based on the needs determined by customers who purchase platform subscription, either as a school, organisation or as an individual. By utilising the account assigned to you (at the request of the purchaser) you accept all the policies and terms of conditions of use published on Our Site and Our Platform.
The intention of this privacy notice is to provide transparency regarding what personal data PWA may hold about you, how it will be processed and stored, how long it will be retained and who may have access to your data.
Personal data is any information relating to an identified or identifiable living person (the data subject). An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number or factors specific to the physical, genetic or mental identity of that person, for example.

“Our Platform”: means the Peach Wellness Academy e-learning platform you will access as a User to make use of the content within.

"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on, or forms part of, Our Site or Our Platform;

Peach Wellness Academy provides health and wellbeing education through Our Site, Our Platform and Our social media feeds. Our aim is to provide high
quality, factually accurate and reliable health and wellbeing information. All the information we
collect is to support this aim.
6. What this privacy
notice covers
This privacy notice only covers the processing of personal data by PWA that
has been obtained from data subjects accessing Our Site or Our Platform. It
does not cover the processing of data by any sites that can be linked to or
from this website, we encourage you to read the privacy statement on other
websites accessed this way.
When providing PWA with any of your personal data for the first time, for
example, when you first subscribe or login to Our Platform, or sign up to our
e-newsletter you will be asked to confirm that you have read and accepted the
terms of this privacy notice and / or Our Platform terms and conditions of use.
A copy of your acknowledgement will be retained for reference.
If our privacy policy changes in any way, we will place an updated notice on
this page. Regularly reviewing the page ensures you are always aware of what
information we collect, how we use it and under what circumstances, if any, we

7. Why PWA collects
your personal data
Personal data may be obtained from education providers, employing
organisations and / or individuals in connection with the functions of PWA.
Your personal data is collected and processed for the purposes of, and in
connection with, the functions that PWA performs in the provision of health and
wellbeing education services. The collection and processing of this data is
necessary to perform those functions.
PWA collects and uses your personal information for the following purposes:
- facilitate
and manage subscription to Our Platform and Systems;
- supporting
your health and wellbeing education;
- keeping
you informed of changes to Our platform or PWA related products and
services;
- quality
assurance of our educational content and to ensure that standards are
maintained; and
- research
and audit purposes.
We also collect and use personal information from you so that we can provide
personnel related support services and education to your school or organisation
(only applicable to school / organisation subscription plans), to promote our
services, to monitor our own accounts and records, to monitor our educational
content usage, and to report on the utilisation of our educational content.
Please note that not all of the PWA lawful bases will
apply for each type of processing activity that PWA may undertake. However,
when processing any personal data for any particular purpose, one or more of
the above lawful bases will apply.
Without limitation, any of the following Data may be collected:

Any special category data (including data relating to racial or ethnic
origin, political opinions, religious beliefs, sexual orientation and data
concerning health) will only be collected with your prior and explicit consent
and may only be done so anonymously as part of specific approved surveys for
the purposes of research and audit and reporting on utilisation of Our
educational content.
Use of communications Systems (e.g. community forum) within Our Site or Our
Platform may result in personal and / or special category data being collected
as user generated content within those Systems. Terms and conditions of use for
these Systems must be read and agreed to before access is permitted which
includes providing your explicit consent to process and collect this Data.
Any personal Data you submit will be retained by PWA for
as long as you use the Services and Systems provided on Our Site or Our
Platform.
User generated Data that you may submit through any communications System
(e.g. community forum) that we may provide may be retained for a longer period
of up to one year before deletion occurs.
Unless we are obliged or permitted by law to do so, and subject to Clauses
10 and 27, your personal Data will not be disclosed to third parties. This
includes our affiliates and / or other companies within our group.
All personal Data is stored securely in accordance with the principles of
the Data Protection Act 2018 and the UK General Data Protection Regulations

Any or all of the Data in Clause 8 may be required by us from time to time
in order to provide you with the best possible service and experience when
using Our Site and Our Platform. Specifically, Data may be used by us for the
following reasons:

management and internal record keeping;

of our products / services;
- transmission
by email of promotional materials that may be of interest to you;
- contact
for market research purposes which may be done using email, or telephone.

We may share anonymised and aggregate data within services across PWA and third-party organisations, public bodies or approved academic
researchers for the purpose of providing the best possible health and wellbeing
education.
Personal data which has been anonymised and aggregated will cease to be
personal or identifiable data meaning that you cannot be identified as the Data
Subject from that data. Anonymised and aggregated data is not subject to GDPR.
We may share information, where necessary, to prevent, detect or assist in
the investigation of fraud or criminal activity, to assist in the
administration of justice, for the purposes of seeking legal advice or
exercising or defending legal rights or as otherwise required by the law.
The GDPR imposes restrictions on the transfer of personal data outside the
European Union, to third countries or international organisations, in order to
ensure that the level of protection of individuals afforded by the GDPR is not
undermined.
Your data may only be transferred abroad where PWA is assured that a third
country, a territory or one or more specific sectors in the third country, or
an international organisation ensures an adequate level of protection as
defined by a GDPR Adequacy Decision or, in the absence of this, Standard
Contractual Clauses (SCC) or Binding Corporate Rules (BCR) or derogation
(explicit consent from the Data Subject).
When you use Our Site or Platform, small files called cookies may be stored
on your device to improve your experience, such as tracking site speed, usage,
and saving your preferences. Google Analytics collects data like visited pages,
time spent, referral source, and clicks, but does not gather personal
information, so users remain anonymous. We do not permit Google to use or share

Our Site and Our Platform use embedded media like YouTube videos, which may
place third-party cookies on your device. You can opt out of this type of data
collection by visiting the third parties’ websites.

13. Contact forms and
e-newsletter
When completing a Contact form on Our Site, you will be asked to provide an
email address so that we can answer your questions. This is stored on the
website and then forwarded to PWA data centres located in the UK.
When registering to receive the PWA e-newsletter via our site, you will be
asked to provide your email address. This will be stored on our partner
marketing platform Mailerlite based in the EU and PWA managed systems based in
the UK. This process complies with UK data protection legislation including the
Data Protection Act (DPA) 2018 and UK General Data Protection Regulations
(GDPR). Data processed by Mailerlite is stored in EU data centres and is

14. Third Party
websites and services
PWA may,
from time to time, employ the services of other parties for dealing with
matters that may include, but are not limited to, payment handling, search
engine facilities, advertising and marketing. The providers of such services do
not have access to certain personal Data provided by Users of Our Site or
Our Platform.
Any Data used by such parties is used only to the extent required by them to
perform the services that PWA requests. Any use for other purposes is
strictly prohibited. Furthermore, any Data that is processed by third parties
must be processed within the terms of this Policy and in accordance with UK
data protection legislation.
15. Information that we
may need to send you
We may send you information about specific platform or System content or
features based on your Account access and User activity. We will avoid sending
any generic information but if necessary or directed by your school or
organisation, will be displayed on Community Noticeboards within Our Platform.
PWA is not responsible for information provided to you via the platform
Community Noticeboard by your school or organisation’s facilitators, or on
behalf of your school or organisation (applicable only to school / organisation
subscription plans).
16. Changes of business
ownership and control
PWA may,
from time to time, expand or reduce its business and this may involve the sale
of certain divisions or the transfer of control of certain divisions to other
parties. Data provided by Users will, where it is relevant to any division so
transferred, be transferred along with that division and the new owner or newly
controlling party will, under the terms of this Policy, be permitted to use the
Data for the purposes for which it was supplied by you.
In the event that any Data submitted by Users will be transferred in such a
manner, you will be contacted in advance and informed of the changes. When
contacted you will be given the choice to have your Data deleted or withheld
from the new owner or controller.
17. Controlling access
to your Data
Wherever you are required to submit Data, you will be given options to
restrict our use of that Data. This may include the following:

18. Your right to
withhold information
You may access certain areas of Our Site without providing any Data at all.
However, to use all Services and Systems available on Our Site and Our Platform
you may be required to submit Account information or other Data.

19. Accessing your own
Data
You may access your Account at any time on Our Platform to view or amend the
Data. You may need to modify or update your Data if your circumstances change.
Additional Data such as to your marketing preferences may also be stored and
you may change this at any time.
You have the right to ask for a copy of your personal Data free of charge.
20. Right to
rectification and erasure
Under the GDPR you have the right to request that incorrect or inaccurate
personal data be rectified and the right to request erasure of your personal
data.
The right to erasure is not an absolute right and it may be that it is
necessary for PWA to continue to process your personal data for a number of
lawful and legitimate reasons.
Data security is of great importance to PWA and to protect your Data
we have put in place suitable physical, electronic and managerial procedures to
safeguard and secure Data collected online.

Our processing of all personal data complies with UK data protection
legislation including: the Data Protection Act 2018; and the UK General Data
Protection Regulation. The security of the data is assured through the implementation of PWA’s policies on information management as set out in this notice.
The personal data we hold may be held as an electronic record on data
systems managed by PWA. These records are only accessed, seen
and used as required and / or permitted by law by staff who need access to
personal data so they can do their jobs and other partner organisations under
data sharing agreements.
We make every effort to keep your personal information accurate and up to
date, but in some cases, we are reliant on you as the Data Subject to update
your Account Data or notify us of any necessary changes to your personal data.
If you tell us of any changes in your circumstances, we can update the records
with personal data you choose to share with us.
We will keep your personal data for no longer than necessary, in line with
our records management policy. When a User Account is terminated all personal
data will be erased and non-recoverable. User generated data entered on
communication Systems (e.g. community forum) within Our Site or Our Platform
now, or in the future, may remain for up to one year before deletion occurs.
PWA policy is to observe the Cabinet Office transparency and
accountability commitments towards more open use of public data in line with
relevant and applicable UK and European legislation. PWA would
never share personal data through the Open Data facility. To this end, Peach
Wellness Ltd will implement Information Governance protocols that reflect
Information Commissioner’s Office recommended best practice for record
anonymisation, and Office of National Statistics guidance on publication of
statistical information.
PWA policy is to observe the Cabinet Office transparency and

relevant and applicable UK and European legislation. PWA would
